The Supreme Court of Appeal has dismissed with costs, Ngwathe Local Municipality’s application for Leave to Appeal an earlier order by the Free State High Court Division in Bloemfontein.
The High Court had issued a declaratory order against the municipality that it is in breach of its constitutional obligations towards its residents and the Executive Council of the Free State Province directed to intervene in the affairs of the municipality and inter alia to dissolve the municipal council and appoint an administrator.
The Executive Mayor of Ngwathe Local Municipality, Cllr Victoria De Beer-Mthombeni said the municipality has taken note of the judgement of the Supreme Court of Appeal and they will study the outcome and make pronouncements in due course on the process going forward.
Meanwhile Afriforum has welcomed the Supreme Court of Appeal’s decision handed down on the 22nd October 2025, that citing no reasonable prospects of success, and no other compelling reason why an appeal should be heard.
