Free State Provincial authorities abide by the court order in the Ngwathe matter

The Free State Provincial Executive Council and the Department of Cooperative Governance Traditional Affairs and Human Settlements have resolved to abide by and not appeal the judgement on invocation of section 139(5) of the constitution in the Ngwathe Local Municipality.

The judgement was handed down on the 20th June 2025, by Judge J Daffue. The department said after deliberations and the legal advice obtained both the Executive Council and the Department decided to abide by the decision and not appeal.

The department further said while it has its own reservations about its prospects of success it respect the Council of Ngwathe’s right to appeal. “We therefore as the Department and the Executive Council, will await the court decision on the appeal lodged by the 1st and 4th respondents in this matter”.
